You have the right to return or exchange a purchased watch in accordance with the current legislation of Ukraine. However, certain conditions must be met, depending on the quality of the product.
Exchange or Return of Goods of Good Quality
According to Article 9 of the Law of Ukraine “On Consumer Rights Protection”, you have the right within 14 days (excluding the day of purchase) to exchange a watch of good quality for a similar one or return it and receive a refund if it does not fit in shape, size, color, style, or cannot be used for its intended purpose. Key conditions:
- The watch has not been used.
- Its merchantable condition, consumer properties, seals, factory packaging, and all documents are preserved.
- If a similar product is out of stock at the time of request, you have the right to choose another model with a price recalculation, return the product and receive a refund of its cost at the time of purchase, or wait for a similar product to arrive.
Return or Exchange of Goods of Inadequate Quality
According to Article 8 of the Law of Ukraine “On Consumer Rights Protection”, if significant defects caused by the manufacturer are discovered during the warranty period, you have the right to demand a replacement of the watch or a refund.
A defect is considered significant if it:
- makes it impossible to use the watch for its intended purpose;
- arose through the fault of the manufacturer;
- reappears after being fixed;
- cannot be fixed at all, or its fixing requires more than 14 calendar days, or it makes the product substantially different from what was stipulated by the contract.
An expert examination may be conducted at an authorized service center to verify the quality. If your claim is justified, the replacement of the product or refund is carried out immediately (subject to availability) or within two months. In case replacement is impossible, you have the right to choose another model with a price recalculation or get a refund.
Who Pays for Shipping Upon Return or Exchange?
Payment for logistics services in case of product return or exchange depends on the reason for the request:
- Goods of inadequate quality (defect, flaw): if the return or exchange is due to inadequate quality or a factory defect, the seller is obliged to fully reimburse the buyer for shipping costs.
- Goods of good quality (does not fit): if the product is returned or exchanged at the buyer’s initiative without any defects (for example, the watch does not fit in size, color, or design), the cost of return shipping is paid by the buyer.
Refunds
For goods of good quality, the refund amount is calculated based on the cost at the time of purchase. The money is returned on the day the request is made, but no later than 7 days in case of technical impossibility.
For goods of inadequate quality, the calculation is based on the price at the time the request is made (if the price has increased) or at the time of purchase (if the price has decreased). The money is returned on the same day or within 7 days.
What Documents are Required for Return or Exchange?
To process your application, please make sure to provide:
- A fiscal or sales receipt confirming the purchase;
- The complete set of product components;
- Factory packaging;
- A filled-out warranty card.
Important Conditions for the Exchange/Return of Goods of Good Quality
- The product is not included in the List of goods that are not subject to exchange/return.
- No more than 14 days have passed since the date of purchase.
- The watch has not been used: there is no user registration, the length of the bracelet has not been changed, and the software has not been interfered with (no programs have been installed, modified, or deleted).
- Merchantable condition is preserved: there are no scratches, scuffs, signs of wear, moisture, dirt, or damage.
- All functions of the watch work properly, and there are no defects.
- Seals, tags, protective films, and markings are intact. There are no inscriptions on the product or packaging.
- A payment document, warranty card, manual, etc., are available.
Consumer Obligations Before Operation
According to Paragraph 3 of Article 4 of the Law of Ukraine “On Consumer Rights Protection”, you are obliged to:
- Carefully read the operating rules in the documentation provided by the manufacturer or seller.
- If necessary, contact the seller or manufacturer for clarification before starting to use the product.
- Use the watch exclusively for its intended purpose and comply with the conditions specified in the operating documentation.
- Comply with the safety measures provided by the manufacturer or generally accepted rules for similar goods.
